This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from optimal.health (the “Site”).
PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.
Privacy of “Confidential Testing Information”
Optimal.Health will make all reasonable efforts to maintain the private information of our consumers, test donors, and sample collectors (hereinafter “Confidential Testing Information”). Confidential Testing Information may consist of consumer/donor/collector names, addresses, phone numbers, dates of birth, social security numbers, employment information; test or specimen ID #, test dates, test times, test results, the reason for the test, type of test, test conditions, the identity of the testing laboratory, or identity of the person requesting test.
Except as set forth herein, Optimal.Health will not intentionally disclose Confidential Testing Information to any third party and will make reasonable efforts to protect Confidential Testing Information from disclosure to third parties. You may authorize, in writing, the release of your testing results to third parties, and Optimal.health assumes no liability resulting from such authorized release of information.
In the event of a lawful subpoena or other order of any court of competent jurisdiction for Confidential Testing Information, Optimal.Health will comply with such court order, and Customer hereby acknowledges that under such circumstances Confidential Testing Information may be disclosed by Optimal.Health. The customer further acknowledges that optimal. health may contract with third-party laboratories to conduct testing of samples, and that such third-party laboratories may maintain records of such tests. Customer acknowledges Optimal.Health has no control over the conduct or omissions of such third-party laboratories. Optimal.Health hereby disclaims any and all liabilities for any disclosure by such third party laboratories of Confidential Testing Information.”
We collect Device Information using the following technologies:
- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.
Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.
When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.
HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).

1. Important Definitions. When we use the term “Personal Information” in this Privacy Policy, we mean information about you that is personally identifiable to you, such as your contact information (e.g., name, address, email address, or telephone number), personally identifiable health or medical information (“Health Information”), and any other non-public information that is associated with such information (collectively, “Personal Information”). When we use the term “De-Identified Information”, we mean information that is neither used nor intended to be used to personally identify an individual. Lastly, when we use the term “Cookies”, we mean the small pieces of information that a Site sends to your browser while you are viewing a website.

3. HIPAA. Our privacy practices are intended to comply with the Health Insurance Portability and Accountability Act (“HIPAA“). We will maintain the privacy of your Health Information as required by HIPAA and the regulations promulgated under that Act. We encourage you to review our Notice of Privacy Practices, which describes how we may use and disclose your Health Information.
4. Children under age 18. We do not knowingly allow individuals under the age 18 to create Accounts that allow access to our Site.
5. The Personal information we collect or maintain may include:
Your name, age, email address, username, password, and other registration information
Health Information that you provide us, which may include information or records relating to your medical or health history, health status and laboratory testing results, diagnostic images, and other health-related information
Health information about you prepared by the health care provider(s) who provide the Services through the Site, such as medical records, treatment, and examination notes, and other health-related information
Billing information that you provide us, such as credit card information
Information about the computer or mobile devices you are using, such as what Internet browser you use, the kind of computer or mobile device you use, and other information about how you use the Site
Other information you input into the Site or related services
6. We may use your Personal Information for the following purposes (subject to applicable legal restrictions):

- To improve the quality of healthcare through the performance of quality reviews and similar activities
- To create De-identified Information such as aggregate statistics relating to the use of the Service

- To improve our website in order to better serve you.
- To allow us to better service you in responding to your customer service requests.

- To fulfill any other purpose for which you provide us Personal Information

- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Optima.health's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information maintained by the Site is among the assets transferred.

8. Information We Collect via Technology.
We collect information from you when you register on our site, place an order, subscribe to a newsletter, respond to a survey, fill out a form, Use Live Chat, Open a Support Ticket, or enter information on our site.
Provide us with feedback on our products or services.
As you use the Site or the Service, certain information may be passively collected by Cookies, navigational data like Uniform Resource Locators (URLs), and third-party tracking services, including:
Site Activity Information. We may keep track of some of the actions you take on the Site, such as the content of searches you perform on the Site.
Access Device and Browser Information. When you access the Site from a computer or other device, we may collect anonymous information from that device, such as your Internet protocol address, browser type, connection speed, and access times (collectively, “Anonymous Information”).

Real-Time Location.
Certain features of the Site use GPS technology to collect real-time information about the location of your device so that the Site can connect you to a health care provider who is licensed or authorized to provide services in the state where you are located.
Mobile Services.
We may also collect non-personal information from your mobile device or computer. This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include how you use the application(s) and information about the type of device or computer you use. In addition, in the event, our application(s) crashes on your mobile device we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our application(s).
Google Analytics.
We use Google Analytics to help analyze how users use the Site. Google Analytics uses Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from Google Analytics only to improve our Site and Services. Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other personally-identifying information. Although Google Analytics plants a persistent Cookie on your web browser to identify you as a unique user the next time you visit the Site, the Cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.
9. De-Identified Information. We may use De-Identified Information created by us without restriction.
10. Information You Share With Third Parties. This Privacy Policy applies only to information we collect through the Site and in email, text, and other electronic communications set through or in connection with the Site. This policy DOES NOT apply to information collected by any third party. When you click on links on the Site you may leave our site. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements.
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
Some medical information is not suitable for children under the age of 18.
MINORS
The Site is not intended for individuals under the age of 18.
